Terms of Use & Conditions – White Spirit

The website www.whitespirit.co.il (the “Website”) is operated by Dor Sendler LLC, a company incorporated in the State of Florida, USA (the “Company”). Logistics and shipping in Israel and in the United States are carried out via service providers engaged by the Company.

Any use of the Website, including browsing, registration, and placing an order, constitutes full and explicit acceptance of these Terms in their entirety. These Terms form a legally binding agreement between the user and the Company.

1. Definitions

  • “Company” – Dor Sendler LLC, Florida, USA.

  • “Website” – www.whitespirit.co.il and all content pages and services included in it.

  • “User” / “Customer” – any person browsing the Website or performing any action on it, including purchasing products.

  • “Products” – jewelry and any fashion or lifestyle item offered for sale on the Website.

2. Services and Products

  1. The Website enables online purchase of jewelry and any additional products that the Company may offer in the future.

  2. Products, prices, shipping terms, and delivery times may be changed at any time at the Company’s sole discretion.

  3. Images on the Website are for illustration purposes only. Slight differences in color, shade, or measurements may occur between what is displayed and the actual product.

3. Prices and Payments

  1. Prices are displayed in United States Dollars (USD). Any conversion shown in New Israeli Shekels (NIS), if displayed, is for illustration purposes only.

  2. Payment is made via Shopify Payments (secure credit card processing) only, unless an additional payment option is explicitly published.

  3. In the event of a typographical error, input mistake, or technical malfunction in the display of price and/or stock – the Company may cancel the transaction.

Charges in Foreign Currency and Currency Conversion

  1. Actual billing is carried out in USD only.

  2. The customer’s credit card company performs the actual conversion into NIS and may charge a currency conversion fee.

  3. The Company is not responsible for any discrepancies between the price shown on the Website in NIS (for illustration) and the actual amount charged to the customer’s credit card.

  4. All charges, refunds, or credits will be made in USD only.

4. Eligibility to Purchase

  1. Placing an order on the Website is permitted for any person over the age of 18.

  2. A minor making a purchase declares that they have obtained the consent of a parent or legal guardian. The Company is not responsible for verifying this declaration.

  3. The Company may cancel a transaction for any reasonable cause, including but not limited to fraud prevention, lack of stock, or refusal of the credit card company to approve the payment.

5. Cancellations, Returns & Exchanges

  1. A transaction may be cancelled in accordance with the Israeli Consumer Protection Law, 1981, within 14 days from the date the product is actually received or from the date the transaction document is provided (whichever is later).

  2. A product may be returned only if it has not been used and is in its original packaging.

  3. In case of cancellation for a reason other than a defect/non-conformity, cancellation fees of 5% of the transaction amount or 100 ₪ (the lower of the two) may apply, at the Company’s discretion.

  4. In case of a defect or non-conformity for which the Company is responsible, the customer is entitled to a full refund including shipping costs.

  5. Returns must be made via courier only, and not by personal delivery.

  6. The detailed policy is set out in the “Returns & Exchanges Policy” page, which forms an integral part of these Terms.

6. Shipping & Delivery

  1. Order processing time: up to 3 business days from the date payment is approved.

  2. Shipping times:

    • Within Israel: up to 3 additional business days.

    • Within the USA: according to the service areas and timelines of the courier companies used.

  3. Products in stock will be shipped promptly. Products not in stock are made to order – estimated production time: 1–2 weeks.

  4. The Company does not undertake to deliver to areas not covered by the courier companies it works with.

  5. Changing the shipping address is possible only before the order has been handed over to the courier. If the order has already been dispatched, a change of address may incur additional shipping fees.

  6. In cases of non-delivery (due to lack of response, incorrect address, or unavailability), the parcel may be returned to the sender, and the customer will bear the cost of reshipping.

  7. International shipments may be subject to taxes/duties/customs or other fees in the destination country. These charges are the sole responsibility of the customer.

  8. Delays caused by force majeure (including strikes, shutdowns, wars, extreme weather, emergencies, or customs delays) will not be considered a breach of the Company’s obligations.

7. Use of the Website

  1. The User undertakes to use the Website for lawful purposes only.

  2. It is forbidden to harm the operation of the Website or the information stored on it.

  3. It is forbidden to use Website content, prices, or images for third-party commercial purposes without prior written consent from the Company.

  4. The Company may block or cancel the access of any User who acts in violation of these Terms.

8. Intellectual Property

  1. All intellectual property rights in the Website, including its design, texts, images, software code, trademarks, logo, and the brand name White Spirit, belong solely to the Company.

  2. It is prohibited to copy, reproduce, distribute, publish, or use any content from the Website without the Company’s prior written consent.

  3. This prohibition also applies to the use of content on social media platforms (Facebook, Instagram, TikTok, etc.).

9. Limitation of Liability

  1. The Company shall not be liable for any indirect or consequential damage of any kind, including loss of income or profits, misuse of products, or delays beyond its control.

  2. The Company’s liability is limited to the actual value of the product ordered.

  3. Slight differences in colors, measurements, or textures between the images on the Website and the actual product may occur and shall not be deemed grounds for any claim beyond what is set forth in the Returns & Exchanges Policy.

10. Notices & Updates

  1. The Company may send notifications related to an order (such as shipping updates, cancellations, or changes) even if the customer has not subscribed to the newsletter.

  2. The Company may change prices, delivery times, or these Terms at any time. Changes will apply from the moment they are published on the Website and will not apply retroactively to past transactions.

11. Governing Law & Jurisdiction

  1. These Terms are governed by the laws of the State of Florida, USA.

  2. Notwithstanding the above, for customers in Israel, the provisions of the Israeli Consumer Protection Law and any other mandatory consumer laws applicable to distance sales shall also apply.

  3. Disputes shall be brought before the competent courts in Florida, unless mandatory Israeli law provides otherwise.

  4. The Company reserves the right to claim alternative local jurisdiction where applicable under the governing law.
